Terms of Service

Rules for using Pace Finity.

1. Scope

These Terms of Service ("Terms") govern the use of the platform "Pace Finity" ("Service"), operated by Thomas Böhringer and Christian Bringmann (jointly the 'Operators'), Schulstraße 62, 86438 Kissing, Germany.

By registering for or using the Service, you accept these Terms.

2. Description of Service

Pace Finity is a GPS-based fitness game that combines outdoor activities (running, cycling, hiking) with gamification elements. The Service enables:

  • Recording GPS activities
  • Conquering virtual territories on a shared map
  • Participating in leaderboards, local battles, and competitions
  • Connecting with third-party services (Strava, Garmin)

The Service is provided as a web application. Native apps (iOS, Android) are planned.

3. Registration and Account

  • Registration with a valid email address is required to use the Service.
  • You are responsible for the accuracy of your account information.
  • Your account is personal and non-transferable.

4. Permitted Use

  • The Service may only be used for lawful purposes.
  • Manipulating GPS data, cheating, or using bots is prohibited.
  • Offensive or discriminatory content (names, avatars, messages) is not tolerated.

5. Data Recording and GPS Accuracy

  • Activities are recorded via GPS and processed into virtual territories.
  • The Operators do not guarantee perfect accuracy.
  • In case of technical errors, territory claims may be adjusted retroactively.

6. Premium Features

  • Certain features are available exclusively for Premium users.
  • Premium is billed monthly or annually.
  • Cancellation is possible at any time for the next billing period.

7. Liability

  • The Service is provided 'as is'.
  • The Operators are not liable for damages arising from use of the Service, except in cases of intentional misconduct or gross negligence.
  • Liability for personal injury remains unaffected.

8. Privacy

  • Personal data is processed in accordance with the Privacy Policy.
  • GPS data from activities may be visible to other users on the map.

9. Changes

  • The Operators reserve the right to amend these Terms.
  • Users will be informed of significant changes.

10. Termination

  • You may terminate your account at any time in the profile settings.
  • The Operators reserve the right to suspend accounts for violations of these Terms.

11. Applicable Law

  • These Terms are governed by the laws of Germany.
  • Place of jurisdiction is Augsburg, Germany.
